Bethesda’s Fallout 76 has faced controversy after controversy since it first launched back in 2018.
Now it’s been confirmed by the Australian Competition and Consumer Commissions board that players will be entitled to a refund of the game, following an investigation into the claim that consumers were “misled.”
The ACCC website writes: “The ACCC has accepted a court-enforceable undertaking from three related video gaming companies after they acknowledged they were likely to have misled consumers about their consumer guarantee rights in relation to the online action game Fallout 76.
“The companies, ZeniMax Media Inc, ZeniMax Europe Limited and ZeniMax Australia Pty Ltd (together, ZeniMax), accepted that their actions were likely to have contravened the Australian Consumer Law (ACL).”
Bethesda Softworks LLC is a part of ZeniMax Media Inc.
The page continues: “The ACCC received complaints that ZeniMax representatives told consumers that they were not entitled to a refund after they had experienced a variety of faults with the Fallout 76 game, including, in some cases, problems with the servers, lagging, graphic and visual problems.”
Australian customers who contacted ZeniMax regarding a refund of their purchase between November 24 2018 and June 1 2019 are to be given refunds under the new findings.
“When a consumer has purchased a product that has a fault which amounts to a major failure, the Australian Consumer Law provides them with the right to ask for their choice of either a repair, replacement or refund,” said ACCC Commissioner Sarah Court.
Bethesda recently unveiled its premium subscription service for Fallout 76, entitled Fallout 1st. The programme has been hit with a huge amount of criticism, and it doesn’t look like the controversy is going to end anytime soon.
Here’s hoping that Bethesda can learn from its mistakes so as not to repeat this debacle with The Elder Scrolls 6!
