Should Google and Nvidia be concerned about the proposed takeover by Microsoft?

In December 2022, reports were making the rounds that the FTC could sue Microsoft over its proposed takeover. It was apparently believed by the FTC that should the takeover be finalised, Microsoft would significantly suppress the industry competition.

What’s more, it was later reported that the FTC was seeking a settlement agreement with Microsoft. Furthermore, it’s claimed that Microsoft would push on with the acquisition regardless of whether an agreement with the FTC is made.

Bloomberg sources claim that both Google as well as Nvidia has submitted information in support of the FTC. It’s believed that the information submitted, claims that Microsoft would gain an unfair advantage in cloud, mobile as well as subscription gaming.

However, the same reports claim that while concerns have been expressed, Nvidia made a case for equal and open access to games. Moreover, it is claimed that despite concerns, Nvidia isn’t directly opposed to the Activision Blizzard acquisition.

In a statement provided to Bloomberg, Microsoft spokesperson, David Cuddy maintained the company’s desire to work with competitors and address any concerns they might have.

We are prepared to address – and have been proactively addressing – issues raised by regulators or competitors to ensure the deal closes with confidence,” Cuddy said. “We want people to have more access to games, not less.

At this time, the FTC claims that there have been no “substantive” talks with Microsoft over a proposed settlement agreement. If no out-of-court settlement is made, a court hearing is expected to take place in August 2023.
